WhoWhatWear.com and Purseblog.com Designer Luggage Giveaway Official Rules
Eligibility: No purchase or payment of any kind is necessary to enter or claim prize. A purchase does not increase your changes of winning. The WhoWhatWear.com and Purseblog.com Designer Luggage Giveaway (the “Sweepstakes”) is open to all legal U.S. residents who are at least thirteen (13) years of age, except employees of Who What Wear LLC and Midley Inc LLC (“Sponsors”), and their respective affiliates, partners, subsidiaries, franchises, distributors, advertising and promotion agencies, and the immediate families or household members of each. The Sweepstakes is subject to all applicable federal, state and local laws and regulations. Void where prohibited or restricted by law or regulations.
How to enter:
Standard Entry: To enter, (1) visit www.whowhatwear.com between 9:00 AM Pacific Standard Time (“PST”) on February 3, 2009 and 11:59 PM PST on March 3, 2009 (the “Sweepstakes Period”) and complete the following three (3) steps: (1) complete the entry form by providing your contact information, (2) then go to www.purseblog.com link provided where you will get a Sweepstakes code, and (3) finally, enter the Sweepstakes code on the line indicated on the entry form at www.whowhatwear.com. In order to be eligible, you must already be a registered subscriber of www.whowhatwear.com or become a registered subscriber of www.whowhatwear.com and remain a registered subscriber from time of entry until 11:59 PM PST on March 3, 2009. Subscribing is free. Only one (1) standard entry per person/email address. Entries with duplicate email addresses or multiple entries using different email addresses for a single individual will be disqualified.
Refer a Friend Bonus Entry: To receive additional bonus entries into the Sweepstakes (after you have entered via the standard method descried above), follow the directions on www.whowhatwear.com and provide valid email addresses of friends, who are eligible to enter the Sweepstakes. For every friend for which (i) you have provided a valid email address and (ii) the referred friend has entered the Sweepstakes, you will receive one (1) bonus entry up to a maximum of ten (10) refer-a-friend bonus entries. You may only refer persons with whom you have an existing relationship. Each friend will be sent a refer-a-friend email notifying them solely about the Sweepstakes.
PurseBlog.com Comment Bonus Entry: For one (1) randomly chosen twenty-four (24) hour period during the Sweepstakes, the Sponsors will provide a bonus entry to all entrants who post a comment at www.purseblog.com in the comments section related to the Sweepstakes. This twenty-hour (24) hour period for bonus entries will not be announced in advance. In order to determine when this bonus entry opportunity is available, go to www.purseblog.com and look for a post which states that it is dedicated to increasing your chances to win the Sweepstakes. Further instructions will be provided in the post. In order to receive a PurseBlog.com comment bonus entry, you must have first entered via the standard method described above. Limit of one (1) PurseBlog.com comment bonus entry, regardless of the number of comments made on PurseBlog.com.
Limit of a total of entries (12) entries (one (1) standard entry, ten (10) refer-a-friend bonus entries, and one (1) PurseBlog.com comment bonus entry per person/per email address during the Sweepstakes Period.
All entries and requests become the property of Sponsors and will not be acknowledged or returned. In the event of a dispute over the identity of an online entrant, entry will be deemed submitted by the authorized account holder of the e-mail account of the e-mail address submitted at time of entry. “Authorized account holder” is defined as the natural person who is assigned to an e-mail address by an Internet access provider, on-line service provider, or other organization (e.g., business, educational institution, etc.) that is responsible for assigning e-mail addresses for the domain associated with the submitted e-mail address.
Prize (1): One (1) winner will receive each of the following handbags: one (1) Keepall 45, one (1) Pegase 50, one (1) Evasion, and one (1) Poche Toileete. ARV of prize: $4,670. Color of handbag will be chosen by Sponsors. Winner will be responsible for all applicable federal, state and local taxes. Prize is non-transferable and no substitution by winner or cash equivalent is allowed. Sponsors reserve the right to substitute prize for one of equal or greater value.
Selection of Winner: One (1) winner will be selected in a random drawing on or about March 4, 2009 (from among all eligible entries submitted during the Sweepstakes Period) conducted by representatives of Sponsors, whose decisions are final and binding in all matters relating to this Sweepstakes. Winner will be notified by e-mail on or about March 4, 2009, and will be given instructions on how to claim prize. Winner will be required to sign and return an affidavit of eligibility and liability release (and, where permitted, a publicity release) within five (5) business days of notification or prize will be forfeited and awarded to an alternate winner. If the winner is considered a minor in his/her jurisdiction of residence, affidavit and release must be signed by the minor’s parent or legal guardian and such prize will be delivered to minor’s parent/legal guardian and awarded in the name of parent/legal guardian. Odds of winning depend on the number of eligible entries received.
Release of Liability: By participating, you release Sponsors and their respective subsidiaries, affiliates, partners, employees, directors, and agents, including advertising agencies, from any and against any and all injury, loss or damage caused or claimed to be caused by your participation in the Sweepstakes and/or the acceptance, awarding, receipt, use and/or misuse of the prize, and you agree that Sponsors and their respective affiliates, subsidiaries, directors, employees and agents, and all others associated with the development and execution of this Sweepstakes are in no matter responsible for any warranty, representation, or guarantee, expressed or implied, in fact or in law, relating to the Sweepstakes and/or the awarding of any prize. Notwithstanding the foregoing, in the event that the preceding release is determined by a court of competent jurisdiction to be invalid or void for any reason, the entrant agrees that, by entering the Sweepstakes, (i) any and all disputes, claims, and causes of action arising out of or in connection with the Sweepstakes, or any prizes awarded, shall be resolved individually without resort to any form of class action; (ii) any claims, judgments and awards shall be limited to actual out-of-pocket costs incurred, including costs associated with entering the Sweepstakes, but in no event attorney’s fees; and (iii) under no circumstances will any entrant be permitted to obtain any award for, and entrant hereby waives all rights to claim, punitive, incidental or consequential damages and any and all rights to have damages multiplied or otherwise increased and any other damages, other than damages for actual out-of-pocket expenses.
Additional Rules: Entry materials/data that have been tampered with or altered, or mass entries or entries generated by a script, macro or use of automated devices are void. No photocopied or mechanically reproduced entries are eligible. Sponsors are not responsible for: (i) lost, late, misdirected, damaged, or illegible entries; (ii) error, omission, interruption, deletion, defect, delay in operations or transmission, theft or destruction or unauthorized access to or alterations of entry materials, or for technical, network, telephone equipment, electronic, computer, hardware or software malfunctions of any kind, or inaccurate transmission of or failure to receive entry information by Sponsors on account of technical problems or traffic congestion on the Internet or at any web site or any combination thereof; or (iii) any injury or damage to entrant’s or any other person’s computer related to or resulting from participating in the Sweepstakes. By participating in the Sweepstakes, you (i) agree to be bound by these official rules, including all eligibility requirements, and (ii) agree to be bound by the decisions of Sponsors, which are final and binding in all matters relating to the Sweepstakes. Failure to comply with these official rules may result in disqualification from the Sweepstakes. Sponsors reserve the right to: (i) permanently disqualify from any sweepstakes it sponsors any person it believes has intentionally violated these official rules; and (ii) withdraw the methods of entry if they become corrupted, (including if a computer virus or system malfunction inalterably impairs its ability to conduct the Sweepstakes), and to select winners from among all eligible entries received at time of termination. Entry constitutes consent to the use of prize winner's name, voice, picture and/or likeness without compensation for promotion purposes.
LEGAL WARNING: ANY ATTEMPT BY AN INDIVIDUAL, WHETHER OR NOT AN ENTRANT, TO DELIBERATELY DAMAGE, DESTROY, TAMPER OR VANDALIZE THE SWEEPSTAKES WEB SITE OR INTERFERE WITH THE OPERATION OF THE SWEEPSTAKES, IS A VIOLATION OF CRIMINAL & CIVIL LAWS AND SPONSORS RESERVE THE RIGHT TO SEEK DAMAGES AND DILIGENTLY PURSUE ALL REMEDIES AGAINST ANY SUCH INDIVIDUAL TO THE FULLEST EXTENT PERMITTED BY LAW.
